Constraint in the production of evidence in crimes of sexual rape. Case study of Machava II Health Center (2021 – 2023)

Sexual violence is a reality in practically the entire world. I would say, perhaps, that is one of the cruelest acts that someone can do to another person, especially if they are minors. For this reason, the Law strongly condemns those who commit this act. However, for such a conviction, there must be evidence, so much so that there cannot be any errors in its production. But, unfortunately, this is not what has been seen. There have been constraints in the production of evidence, specifically in forensic medical examinations, which are considered one of the main forms of evidence. Given this reality, this research aims to analyze the institutional constraints that hinder the collection of evidence in cases of sexual violence. More specifically, the research aims to identify the factors that contribute to the late request for examinations by the courts; Describe the procedures followed by the Machava II Health Center to carry out forensic medical examinations; investigate the consequences of the failure or delay in carrying out the examinations in a timely manner, and ensure that victims have access to justice. In order to achieve these objectives, a qualitative study was conducted, using a questionnaire as the data collection instrument, which was administered to employees of the Machava Court, Machava II Health Center and victims of sexual violence. The data revealed that the lack of a deadline for requesting forensic medical examinations is the main factor contributing to delays in their performance. This has been reflected in some cases, as the court is unable to convict the accused due to a lack of evidence, causing greater suffering to the victim. Furthermore, there was a need for better communication between the judicial system and hospitals regarding the performance of these examinations to ensure they are completed within the necessary timeframe.
